“Cultural Protection or Market Distortion? The French Minimum Books Delivery Fee Before the CJEU”.
The case explores the line between market freedoms and national cultural policy within the EU’s internal market. France’s attempt to impose a minimum delivery fee for books sold online to protect small local bookstores against the large platform raises important legal questions on the free movement of goods and services, the scope of the EU Services Directive, and the role of cultural justifications under EU law.
In my piece, I reflect on Advocate General Szpunar’s recent Opinion, the evolving nature of retail in the digital age, and what this means for platform regulation, cultural diversity, and the internal market’s future.
